A Vatandar has the right to transfer vatan lands for his life; on a transfer of vatan land by one of two joint owners with the consequent of the other the time for recovery of the same runs from the death of the survivor of the two joint owners. [...] The Transfer of Property Act does not apply to morgages before the passing of the Act ; where a mortgage was effected in the year 1869 and it was stipulated that the mortgagee in possession should manage the property taking the profits in lieu of interest and a period of 15 years was fixed for redemption and a suit was brought in the year 1906 for sale held that the suit would lie. [...] With regard to the address of the writ to the gaoler I regret that the advisers of the Crown refused to consent on our suggestion to the amendment of the writ by the addition of the name of the gaoler ; but there may have been good' reasons for the refusal of which I am not in a position to express an opinion. [...] I recognize' that a country which originally was a foreign country outside the territorial dominions of the Crown might in course of time become a part of the territorial dominions of the Crown and this by the acts of the Crown without any formal act of annexation especially in a case where the land in question had ceased to be a land in which British subjects were to use the words of sec. [...] The first Court on a construction of the kabliyat held that the Plaintiff was not entitled to claim the price of the crops according to the curent rent and was entitled only to claim the amount as mentioned in the kabuliyat that the case in 3 C. W. N 151 did not apply inasmuch as in that case the alternative money value was mentioned merely for the purpose of registration whereas it was no
