THE ARGUMENT ON BEHALF OF THE BOARD OF Revenue observe their Lordships " appears to us to give the go-bye to the realities of the case and to concentrate atte [...] Until the money was handed over to the creditor it throughout cotinued to be the Company's money and to be in the Company's possession It loses sight of the true relations between those cocerned to say that there was a contract between the cashier and the assistant or that consideration moved between them : for the purpose of the matter in hand they were parts of the machinery wherby the [...] It was the Permanent Settlment that definitely declared the zemindars to be landowners in the English sense and to it must be attributed the transplantation of practically the whole M the English law of landlord and tenant into Bengal much to the advantage of the zemindars. [...] The question arises what is the quatum of interest which a permanent tenure-holder acquires and what is the value of the reversion left to the zemindar ? ACCORDING TO ENGLISH LEGAL IDEAS THE zemindar tieing the proprietor when he grants leases either for a term or in perpetuity is " entitles to the rent of all land lying within the zemindari and the rights of mining fishing and incorporea [...] The transfer of a decree for maintenance to the extent of the arrears is valid ; and the transferee of a portion of the decree may be recognised by the Court.
