In fact it may be regarded as adding to the authority of the prnouncement of the Lord Chief Justice as it suports in main the dicta of the majority of the Judges" of the King's Bench Division. [...] When the writ has been sued out in some civil case as to determine the right to the custody of a child an appeal may be taken either against the order to issue or the refusal to issue the writ up to the House of Lords (Rex v. Barnardo (1891); but when it is sued out in any criminal cause or matter the decision of the judges of the High Court is final. [...] tiff to make good the deficiency the original value placed by the Plaintiff must be taken as the value of the suit for the purpose of regulating the proper appellate Court but we think that when there has been such an order accepted by the Plaintiff from that moment the value of the suit must be taken as being in accordance with the fee paid by the Plaintiff." [...] Io Fugitive Offenders Act : The section is as follows :—" Where it is made to appear to a superior Court that by reason of the trivial nature of the case or by reason of the application for the return of a fugitive not being made in good faith in the interests of justice or otherwise it would having regard to the distance to the facilities for communication and to all the circumstances of th [...] In fact I adopt in the main the dicta as to the questions arising in the dicta of the majority of the Judges in the King's Bench Division.
