IN THE WORDS OP THE MASTER OF ROLLS li FOR taxi the first time a very important question as to the nature and extent of the obligations of a railway company towards traders desirous of using their own rolling stock loaded with merchandise for lxxi the purpose of having such merchandise carried by a railway company upon the terms of payment of the proper rates for such merchandise was lxxii raised [...] We have no doubt that the view of the law as expressed in the three last-mentioned decisions represents the correct view of the matter and that the Legislature has in fact abandoned the theory underlying Ch. [...] it is said that the Conway is a tidal liver at the point in question and further that whether it is tidal or not the Earl of Ancaster claims to be and is the owner of the entirety of the river bed. [...] On the 9th of September 1895 Raja Girish Chunder Roy Bahadur instituted a partition suit in the Court of the Subordinate Judge of Sylhet in Bengal against the predecessors in interest of the Petitioners and 93 other Defendants for the partition of lands consisting of 21 mouzahs and several taluks. [...] a The Court of first appeal found that the Chanels through which the water was taken were different but that the openings made in the embankment were different in different years according to the height of the water.
