The cargo on one of the ships was damaged and the claim raised the question whether the said cargo owners could recover the whole or only a moiety of their damages from the owners of the other ship. [...] The Court of first instance held OW the sale of the trees to the Defendants was not for the benefit of the idol and could not prevail over' the lease obtained by the Plaintiffs from the present shebait and decreed' the suit. [...] On appeal the Subordinate Judge held that though the sale was not for the benefit of the idol the Defendants were assign: es for value and 12 years having passed from the date of the sale the claim was barred under Art. [...] If' such a suit was brought by the successor to the shebait who made the alienation the limitation as against him runs not from the date of his succession to the shebait-. ship but from the date of the alienation. [...] 5 produced before the SuJudge a certified copy of the notice and of the ordesheet of the Collector but did not ask that 'Court to take evidence as to the service of the notice or his' want of knowledge of the mortgage within one year and the said documents were not exhibited.
