ASQUITH IS REPORTED TO have said in answer to a question put to him in the House of Commons that the question of combining the judicial functions of the Privy Council and the House of Lords into one ultimate Court of Appeal for the Empire would be consdered at the Imperial Conference. [...] But if the land blonged to private parties then all that was needed was to arm it with power to make a fair valuation of the totality of interests comprised in it by its own officers and pay up the amount to the owner or owners according to their respective shares awi interests subject to the latter being allowed to test the valuation and the apportionment in the Civil Court by asking the Col [...] v. The Secretary of State for India in Council T 5 C. W. N. 87 "the question of the legality of the acquisition or the impropriety of the award of the Collector were not intended by the Legislature to form t he subject of enquiry by the Land Acquisition Judge at the instance of the Secretary of State." This being the position so far as the provisions of the Act are concerned the question ari [...] The jury found that the accident was due to the negligence of the driver and the non-provision of a conductor. [...] He further directed them that the act of the Defendants in authorizing the erection of the stand was an illegal act and that in his opinion the Corporation was liable in damages for the individual loss sustained by the Plaintiff in consquence thereof if she had in fact sustained any loss therefrom in addition to the inconvenience comon to the general public.
