This is the thirteenth issue of the publication and the careful manner in which the work has been revised in the present edition bears testimony to the strenuous and ceaseless.efforts on the part of the editors to bring it up to date and to make it a " practical " handbook for every-day use in the truest sense. [...] The Defendants paid off the said mortgage and became entitled to the legal estate and to the possession of the deeds and now claimed paym nt of the money before delivering the deeds. [...] Not only is the purchase of shares and the guarateeing of dividends no part of the duty of a solcitor and still less of his clerk but the actual loss in this case was caused by the transfer of the legal estate into the clerk's name and this transfer it was equally no part of his duty to accept. [...] The learned Judge in the course of his judgment against the Defendant said :- With regard to those contentions I have come to the conclusion that the whole matter was fraudulent : the so-called contract was fraudulent in the representation of the existence and position of the Madagascar scheme and I ihink the laguage of Lord Collins in Earle v. Kinocote (1900) Ch. [...] It seems immaterial to consider the effect of the decree for judicial separation as the great point insist ed upon by the counsel for the Plaintiff was the liability of the Defendant acting as an indepenetit versou and cognisant of and benefiting by the frauds.
