The cheap claptrap of the advocate was the sort of line the popular Press got hold of and when it went out to the world on the authority of Mr. [...] On the grounds first that the learned Judge had been wrong in allowing the case to go to the jury secondly that there had been misdirection on the part of the learned Judge ; thirdly that the verdict was perverse ; and lastly that the verdict had been largely induced and influenced by improper conduct of the case by the Plaintiff's counsel Mr. [...] of appeal which runs thus :—That the trial of the issues involved in the case was' prejudiced by the improper conduct of the case by the learned cou* sel for the Plaintiff. [...] The appeal was by the judgment-debtor and the sole point for determination was whether the applcatibn of the decree-holders dated the 16th Deceber 1910 to execute their mortgage decree of the 26th May 1899 was barred by the three years' rule or any rule of limitation. [...] U. to the dismissal of the judgment debtor's appeal by the High Court on the 4th March 1910 it was impossible for the decree-holders to execute their decree for an amount which could not be ascertained until the High COutt had dealt with the contentions of the judgment.debtor.
