Sivaswamy Iyer has been appqinted a member of the Executive Council to the Governor of Madras in the place of the late Mr. [...] The principle: laid clOwn there is that the costs in repect of the claim or the counter-claim are to be awarded quite independently of the one or the Sharpe V. Raggith IN WHICH THIS QUESTION came up was a suit where the Plaintiff claimed damages for the sale of a business by fraudulent misrepresentation by the Defendant. [...] The Plaitiff admitted however that f90 was due to the Defendant for the stock-in-trade and for which sum she pleaded that she was willing to give credit to the Defendant against the damages claimec.-7 Defendant counter-claimed 490 and the Plaintiff in defence to the counter-claim admitted the amount was due as stated above. [...] on the 19th of January last reversed the judgment of Coleridge J. and entered judgment for the Plaintiff for 15o and for the Defendant for 190 and ordered that Plaintiff was to get the costs of the claim and the Defendant of the counter-claim. [...] It need hardly be added that the rules framed under different provisions of the Act by the Governments of the two Provinces and the High_ Court are also given in the book.
