The Appeal Court affirmed the decision of the Court of First instance and accepted the view of the law taken by the Lord Chief Justice. [...] The learned Judge in the course of his judgment said a polity-holder holding a policy current at the date of the winding-up of a company in liquidation might prove for any amount due to him under the contract of insurance in respect of any loss which had occurred at the date of the winding-up or at any subsequent date before the proof or if no loss had occurred since the date of the windinup h [...] These premiums would go in reduction of the amount of the proof the damages being the amount of the liability insured againsless the premiums which would have to be paid by the insured. [...] It was this es imate of the value of the claim which in his opinion was meant by the Act of 1909 as the "value of the policy " and it was by sec. [...] By the compromise decree it was stipulated that the Defendants should pay the decretal amount in five instalments the first instalment due to be paid in November 1907 the 2nd in January 1908 the 3rd in January 1909 the 4th in January 191o and the last in January 1911.
