There was no bopposiiion either on the part of the members of the Council or the general public to the passing of a measure which would make criminal all conspiracies to commit crimes and such a measure would have amply met the utmost requirements of the times as outlined in the Objects and Reasons of the measure. [...] On a rule being issued by the High Court on the application of the complainant the Sessions Judge pointed out that the grounds on which the rule was obtained had not been urged before him and this was an infringement of the spirit of the High Court's order that in revision matters must first of all be urged before the first Court of revision." The Sessions Judge evidently misunderstood the pract [...] He acted in the discharge of his public duty and before taking the extreme step of appealing to the public he endeavoured to draw the attention of the Lieutenant-Governor to the miscarriage of justice. [...] The lower Apellate Court held that the occupation of the Defendants the heirs of the under-raiyat till the end of 1314 being lawful did not become unlawful in 1315 as the Plaintiff did not take any exception to their occupation of the land in the said year and accordingly held that their occupation was with the tacit consent of the Plaintiff and that therfore they could not be ejected wi [...] Held that under the circumstances there was no tacit consent on the part of the Plaintiff to the Defendants' occupation necessitating the service of a notice to quit or communication of the will of the Plaintiff to the Dafendants to eject them when the suit was brought within the year 1315 itself.
