1626 published in the Gazettof India dated the 3rd of August 1912 we find that the Government of India with the approval of the Secretary of State in Couci: appointed the ist of August 1912 as the date when the said Government of India Act came into opertion and by Notification No. [...] We gather from the above the following rquisites of ad effective sale :— (i) The seller though not the owner must be in possession of the goods or of the documents of title thereof with the consent of the owner. [...] The Magistrate sought the advice of the District Magistrate on the point of law involved in the case namely whether the accused would be amenable to the jurisdiction of the British Court. [...] The Plaintiff's case was that the jalkar was the prperty of the zenindars and that he go: it by a lease from the ijaradars of the Mehal on the 15 h Pous 1287 and that since then he was in possession till the present Defendants began to catch forcibly fishes in the said jalkar. [...] The lease turned upon the terms of a kabuliat executed by the predecessor-in-interest of the Defendants in the year 12 5 or 1828 and the: question was whether the rent of the tenurheld by the Defendants under the Plaintiff was or was not liable to enhancement under sec.
