If the operation ended in disaster to the patient then whatever the circumstances of the case and however praiseworthy the conduct of the doctor might otherwise have Leen he had to pay for the consequences by the forfeit of hi hands. [...] The allegation in the plaint was that the Plaitiff was entitled after the death of the pair according to the custom of the caste to those presents presented by the Plaintiff's family and the Defendants were entitled to those presented by the Defendants' family. [...] Held—That it was a case of the determintion of the right granted and the revival of the original right of ownership and not a case of iheritance from the person to whom the presents were given. [...] As regards the carrying out of the sentence or the exercise of the prerogative of mercy that was a matter for the advisers of the Crown—the Executive— to take into consideration and not for them. [...] The Subordinate Judge dismissed the suit on the ground that an easement of the description was unknown to law ; he also found that no grant could be implied in the circumstances of the case that the alleged necessity had not been established and that if the latrines were restored they would constitute a nuisance to the residents of the neighbourhood.
