If there are other persons who conspired with him for the commission of that offence but took no part in the actual commision of the crime they may be joined with him in the same trial for the abetment of the offence by conspiracy under sec: 109 of the Indian Penal Code. [...] Where in such a case the evidence is to weak to establish a charge for the substanti e offence alleged it would in fact be an abuse of the law and procedure to proceed against the accused on the same evidence in the'expectation of estalishing inferentially a charge of criminal cospiracy in the absence of clear evidence of prconcert or agreement for the commission of such offence which [...] 108 of the Transfer of Property Act does not enact any rule regarding the liability of the assignee but as the assignee becothes the lessee from the date of the assignment according to 138"VoL. [...] It is settled law that the privity of estate 'between the lessor and the lessee's assignee is terminated by the assignment to a third person by the assignee and the latter would not be reponsible to the lessor for rent after he has assiged his rights under the assignment to himself. [...] The learned Judge then issued notice upon the maternal uncle and the maternal grandmother of the daughter of the deceased.
