Besides in the present times the head of the judiciary in Bengal should be one who may be in a position to understand the thoughts and ideas the manners customs and sentiments and even the prejudices of the people. [...] The power of appeal against acquittals was conferred on Local Governments in India under a section which was introduced in the Criminal Procedure Code by a jurist so devoted to the maintenance of the liberty of the subject and so conversant with the theory and practice of English Criminal Law as the late Mr. [...] The provisions however in the Criminal Code which confer on the High Courts very wide powers of revision in any criminal case which may have been tried by a subordinate Court should be the subject of very close scrutiny in the consideration of the reforms of the Criminal Procedure Code. [...] But the Magistrate admitted that the only question he asked the accused before recording the confession was whether the accused was willing to make a statement and to that question the accused replied in the affirmative. [...] What the Magistrate did did not in reality amount to a compliance with the soirit of the statute and the intention of the Legislature.
