Being the first of its kind the 6se naturally attracted considerable amount of public attention and the result the acquittal of the accused maintained to the fullest extent the prestige and dignity of the High Court. [...] The Munsif found in favour of the Plaintiff on the quetion of verification of the plaint but dismissed the suit on other grounds. [...] The front page of the plaint was written on a stamped sheet and the endorsment on the back of the stamp shewed that it was purchased on the 7th May. [...] 99 of the Civil Procedure Code to reverse the decree of the Munsif on the ground of non-verification of the plaint as it was neither any error nor defect nor irregularity within the meaning of that section which affected the merits of the case or the jurisdiction of the Court. [...] 99 of the Civil Procedure Code the Subordinate Judge was not competent to reverse the decree of the Munsif on the ground of non-verification of plaint ; the decree of the Subordinate Judge was set aside and the case remanded for determination on the merits.
