It is therefore not desirable to alter the practice heretofore followed in respect of aplications to the High Court to set aside orders passed by the Calcutta Small Cause Court: The Original Side occupies and has for long occupied the position of a. first Appellate Court in respect of applications from the Cacutta Small Cause Court in revisional matters he they under sec. [...] But on the matters being brought recently to the notice of His Lordship the Chief Justice by the learned Advocate-General the exclusive jurisdiction of the Original Side in such matters was restored. [...] But the apologies "offered lack the candour and cordiality with which forensic friction is ually made up and fogotten by members of the Bar when the cause of the contention in Court is over. [...] They are not only of great assistance to the Bench and the Bar but serve to keep the former up to date and up to the mark. [...] The Small Cause Court Judge found that the :Dlendarrp.aid rent at a uniform rate for a period of more than 20 years and upon the evidence and circumstances of the case held that the Defendant was a raiyat at a fixed rate and had therefore the right to cut and appropriate trees.
