As one of the leaders of the Vakil Bar he was in large practice and it is a matter of common knowledge that he was summoned to the Executive Council of the first (ioyernor of Bengal at a time when his elevation to the Bench was almost a matter of certainty. [...].Having regard to the tendency of the recent decisions of the Calcutta High Court of condemning the practice of filing written. [...] 120 of the Indian Act dealing with the competence of witnesses: In criminal trials the accused shall be a copetent witness in his own behalf and may give evidence in the same manner and with the like effect and consequences as any other witness provided that so far as the cross-examination relates to the credit of the accused the Court may limit the cross-examination to such extent as it thi [...] 300 (Arjanda s. v..Hakim Rai) of which the head-note runs as follows : " The vendors would be entitled to a charge upon the property in the hands of the buyers for the amount of the purchase-money or any part thereof remaining unpaid and for interest thereon " may be quoted as a case overiding the nrovisions of the Interest Act. [...] The case will be heard on merits on condition that the Appelants will first deposit in the lower Court the costs of the Government in both the Courts withinone month from the arrival of the record in the lower Court.
