The appeals to the Judicial of the Privy Council from I odic showed a considerable decline at the commencement of the present year. [...] 406 and make the appeal lie to the Sessions Judge instead of to the District Magistrate which was the law in the first Code of Criminal Procedure that was passed in this country. [...] 20 being fixed as the amount annually payable by Dfendant irrespective of the value of the paddy in different years the rent of the Defendant was " money-rent " within the meaning of sec. [...] On appeal the Sub-Judge held that the rent payable by the Defendant was not money-rent but produce-rent that in the ease reported in 10 C. L. J.1144 the tenant had the option to pay either produce or money-' rent but in the present case the Defendant having agreed to pay produce-rent sec. [...] 15 of the Letters Patent Held that in the case of such an agreement where the tenant agrees that in case of default on his part in paying a fixed quantity of paddy the landlord would be entitled to realise a cetain sum of money as price of the paddy the tenancy is held on produce-rent and not on money-rent and the contract only prescribes the measitre of the damage which the landlord.
