Now that the admission to the Bar in India has practically been restricted to the graduates of the Indian Universities it would not do to say that the members of the Bar in India would not be able to fill any postion of responsibility to which they may be employed. [...] Although the problem of the future of the Bar in India is not the same as in England still we agree in the view expressed in the article under review that it is high time that the cumbrous and wasteful system of training that prelvails in England for the members of the Bar should be changed. [...] Whether the reason for this is that it is part of the law merchant or whther it proceeds on the ground of estoppel is immaterial because in the present case the :Plaintiffs did not sign a blank cheque but a cheque for £2 in figures though not in words; and it is not in my opinion possible to say that they authorized the clerk to fill in the words One hundred and twenty pounds " or to pla [...] When the only negligence suggested against the customer is that he has given an opportnity for a clerk to commit forgery such neglgence is not sufficient to make the customer liable for the forgery and the opportunity is not the proximate cause of the loss. [...] Omission on the part of the Defendants to take exception to the juridiction of the Court could not legalise the acts of the Court.
