The appointment of two Indian members to the Council of the Secretary of State for India in 1907 was soon followed by Minto-Morley Reforms of the Imperial and Provincial Legislative and Executive Councils in India under which the number and propotion of the elected members of the Legislative Councils were increased and 'Indian members were first admitted into the Executive Council' of the Gover [...] This poojah miras involved the duty of the touching the bathing and the adorning of certain idols in the temple the making of offerings to the idols the reciting of mantras and the doing of other similar services. [...] Justice Tayabji was of opinion that no general rule couldbelaid down but the question must be decided with reference to the particular facts of the case including the nature of the functions to be performed by the holder of the office acording to the directions of the founder the remuneration provided for the performance of these functions and similar other matters. [...] The suit was brought on the 18th April 1911 ; the report of the Commissioner who made the local enquiry was received by the Court on the 9th April 1912 the sanction of the Commissioner of the Presidency Division who had authority to grant the sanction under sec. [...] It was inter alia contended on behalf of the Appellants that the suit should be dismissed on the ground that it had been instituted without the sanction of the Commissioner and as there was no apprehension of the suit being barred having regard to the cause of action as stated in the plaint and as found by the lower Appellate Court ; it was further contended that if the suit be not dismissed all
