XXL Calcutta High Court and as the newly-consttuted province of Behar and Orissa had since the establishment of Chartered High Courts in this country been under the jurisdiction of the Cacutta High Court this was but proper as a different course would have had the effect of unsettling many settled things to the serious detriment and hardship of the people of the New Province. [...] She urged that the questions raised were of very great public importance and they included among others the following :- (a) the validity of the Indian Press Act as a constitutional measure (b) the validity of the order of the Chief Prsidency Magistrate (c) jurisdiction of the Madras High Court to revise orders pronounced under the Indian Press Act. [...] 107 Crimirial Procdure Code were initiated against the Pettioners some of whom lived outside the Ditrict of Bankura in the Court of the District Magistrate of Bankura who directed them to show cause before the Sadar Sub-divisional Magistrate as to why they should not be bound 'down to keep the peace for one year and the Sub-divisional Magistrate ultimately directed the Petitioners to [...] P. C. for getting the bonds cancelled but the District 'Magistrate upheld the order of the Sudivisional Magistrate_ The Petitioners then moved the High Court and obtained the present Rule : Hcid—The only question involved is whether proceedings initiated by the District Magistrate under the special powers conferred upon him by sec. [...] 193 of the Indian Penal Code in respect of the statements he made regarding the document the prosecution iu respect of the document itself should not be permitted and thirdly that on the facts alleged by the prosecution there was no " user " by the Petitioner.
