There was a riot in the tent and the result was that some of the rioters of whom Rabia Fakir was one set fire to the tent and a general looting of the property of the circus by the rioters took place. [...] On second appeal to the High Court it was contended that the breach of any condition of the kabinnama would not entitle the wife to divorce herself but that the condtion the breach of which would entitle the wife to divorce herself must be a reasonable and prudent one : Held—It has been found that the husband did take a second wife without the consent of the Defendant his first wife that [...] But the fact that the costs would exceed the value of the claim appears to have been brought to the notice of the Court and the amount aforesaid deposited from time to time under the order of the Court. [...] The order idf the Court was as follows :- "We think that the order of the Munsif with regard to the remuneration of the Commissioner is premature. [...] " The Munsif will therefore be at liberty to rconsider the question of the remuneration of the Commissioner at the time when' he decides the case on the merits without regard to the reference that has already been made to the District Judge and his order thereon.
