Justice Astbury of the High Court of Judicature in England after dismissal of the stilt deprived the Defendant of the costs because the conduct of the case by his counsel had the effect of unduly prolonging the hearing of the case. [...] Mookerjee J. laid down— the delivery of possession by which the dispossession is effected is an act of the Court and when the landlord gets into possession by a process of the Court we do not think it is an act of dispossession by the landlord within the meaning of the article which contemplates a dispossession by the lanlord by taking the law into his own hands and otherwise than in course [...] Madras as usual is maintaining the lead in the matter of law publications and the present volume is the first instalment of what promises to be a very useful compilation of the Imperial enactments of the Indian_Legislature which are in force throughout India. [...] On the 12th September 1917 the Opposite Parties brought a suit to rcover from the Defendant Petitioner the sums realized by him from the tenants of the mehal on different dates running from the 0th May to the 20th August.1914: The Defendant cotended that by the 12th September 1917 any suit for recovery of these.sums from the Dfendant had beconie barred by limitation under Arts. [...] 115 and that the time runs not from the dates on which the various sums were realized but from the date on which the Plaintiff having fulfilled his part of the contract the Defendant failed-to perform his part and to refund to the Plaintiff the sums which he realized.
