Before the appeal came on fur !tearing the decision was set aside by a Full Bench of the Comt and at the hearing the Appellant in view of the change in law did not press the appeal and prayed for exemption from payment of costs. [...] The cfitumstarices in which injunction could be gruted to the Plaintiffs are indinated in the judgment thus : " If they are entitled to an ijunction at all it must be apart from the terms of the lease and solely in respect of their owl) interest in the premises and of some irreparable injury which may be sustained by.the►c throw the acts of the Defendants on the Plaintiffs' own Property in eas [...] Where after an appeal was filed the decision of the High Court on which the appeal was based was overruled by a Full Bench and at the hearing the appeal was not pressed : Had—That under the circumstances the Appellant should not be made to pay the costs of the other side. [...] Theilaw on the subject collected from original texts and judicial decisions have been put together in a form to facilitate easy reference by the busy practitioner but it is apparent that the aim of the author has been to elucidate the priciples in a manner helpful equally to the student and those charged with the practice and the administration of the law. [...] On appeal the Sessions Judge held that the defences had not sufficiently discharged the onus which was on them of proving facts entitling them to claim the right of private defence and that the points urged by the Appellant's Counsel were nest sufficient for setting aside the findings of the trial Court and hence dismissed the appeal.
