One of the questions arising in the case was did the grant extend to licensees of the grantees or was it limited to the classes of persons specfically mentioned? [...] From this point of view it was contended that in this instance the grant ought to be restricted to the Persons or classes of persons named in the tleed." The Court in rejecting this contetion observed : " It may well be that the 'release of *ha tolls constituted the more valuable part of the grant but it is a grant ol a right of 111 with a release to those included in the grant of the right [...] The auction purchaser then applied for delvery of possession of the remaining properties :.Held—That when the Court entertains an aplication to set aside the sale after the order cotlyminu the sale had been made but before the period of three years allowed to the purchaser for applying for delivery of possession has epired time is not to be re droned against the applicant from the dat [...] 'A formal witness for the Plaintiff was examined and after taking a part of the depostion of the next witness the Court rose for the day adjourning the case till the succeeding day. [...] On that day the Plaintiff was not present Dfendants examined a witness and after hearing the argument on the Defendant's side the Court delivered a judgment to the effect that on the evidence before it the Plaintiff had not proved his ease.
