forma Dfendant appointed the Defendant as a guard for the 'protection of the said land and at the time of the purchase the said pro forma Dfendant sent for the Defendant and the :Dfendant admitted that he was in possession olt the land as guard of the pro forma Perrulant. [...] The principal Defendant averred inter alia that upon the plaint Plaintiff had prayed for declaration of title and recovery of possession and also consequential relief in the shape of ejectment and damages and so the valuation of the suit should he the value of the land which was Rs. [...] The value of the subjecmatter of the litigation in this case is the value of the right of a licensee in the land and the law says that he has no right or Elea possession. [...] In a suit for ejectment if value of the suit could be the value of the -rights which on his plaint the Plaintiff seeks to recover the Munsif lias held that the value of Rs. [...] The Petitioner' then moved the High.Court on the ground that the building being.on the bank of the tank was not an ostruction w;ithin-the meaning of see_ 202 and otamed this Rule The Opposite Party in showing cause contended that the High Wirt could not interfere with the order as it was passed by the Magistrate in his administrative.
