The last paragraph says :_ “dad whereas coneuerently with the gradual development of self-governing institutions in the Provinces in proyinCiat matters the largest measure of independence oethe Government of India which is compatible with the due dis#harge by the latter of its own (responsibilities).” If therefore this House was of opinion that it was desirable to give the Provinces of India the [...] It seems therefore me that taking the broad view of the situation Parliament intended to transfer to these Provinces of India complete control subject possibly to the action of the Indian Legislature of the transferred subjects and of the transferred subjects only—those are the only ones I am referring to. [...] The language in which the rights and position of a partransferee have been formulated in Dayamayi' s' case does not justify the conclusion that the effect of this decision has been to validate the transfer of a portion of the holding aganast the landlord in the sense that an entirely new right has been given to such transferee not recognised prior to the said decision. [...] The quantity of enjoyment of the lands foring the subject of tenancy is unrelated to and unconnected with the terrant's liability ivolved in the relationship of tenancy. [...] In the light of the above discussion it can safely be laid down as a sound proposition that With the sale of a part of the holding of a raiyat his right in the portion so transferred is extinguished and transmitted to the tranferee who from the moment of transfer bcomes a ctenant with the recorded tenant.
