1:Iriefly the history of the law on the subject and of the exercise of the power of the Calcutta High Court thereunder from time to time. [...] 27 of Act XVII of 1852 empowered the Supregie Court to make general rules and orders in relation to special cases submitted to the Court for opinion under the Act subject to the approval of the Governor-General in COuncil and also of the Privy Council. [...] 43 of Act VI of 1854 (an Act to amend the practice and course of proceeding on the equity side of the Supreme Courts) likewise empowered the Court to make general rules and orders and to fix the fees and allowances to officers of the Court subject to the like sanction and control of the Governor-General in Council and the Privy Council. [...] On the 'establishment of the Calcutta High Court in place of the Sadder and Supreme Courts under the Charter Act of 1861 and the Letters Patent dated 14th May 186 the prcedure of the Courwas regulated by the prvisions of Act VIII of *1859 as amended by the said Act XXIII of 1861. [...] 37 of the said Letters Patent which provided further that the proceedings in the Testamentary and Intestate Jurisdiction were to be regulated by the rules relating thereto in the Supreme Court's Charter 1774 and the rules in force relatiie2 thereto and the proceedings in the Matrimo nial Jurisdiction were to be regulated by the rules and proceedings of the Court.
