The number of cases entered in the Easter list of the different divisions of the High Court in England and the Court of 'Appeal is 4 472. [...] the result of that -bitce: cation is levied then the arbitrators mad make themselves liable in damages if the partt is successful when he moves the Court to take the award off the file. [...] The filing of the suit has no retrOspective effect' and so does not invalidate the arbitration proceedings had before the filing of the suit ; only the subsequent proceedings are vitiated anc:(Ibe award if made after the filing of the snit will'be &ullity. [...] But if the suit has been stayed or disposed of the arbitration proceeings may be continued from where they were at the time of the filing of the suit.
