The resolution which was eventually adopted by the touncil was in the nature of a recommendation to the Government that such action be taken as_ ftards the conduct of the local officials in the !natter of the 'ejectment of the coolies and their. [...] IL:was therefore quite competent for any member of the Bengal Council to move a resIntim to the effect that in the opinion of the Council the member of the Executive Council in charge of Chandpur affairs had acted irresponsibly and contrary to public opinion in refusing funds for the repatriation of coolies causing great suffeting and unrest in the Chittgong Division and the Council rec [...] 323 it is ruled that in such a case the Court must examine the evidence relating to the conduct of the parties subsequent to the execution of the deed. [...] C.) their Lordships of the Judicial Comittee disallowed interests to the mortgagee frorn the date of the decree of the Subordinate Judge to the disposal of the appeal by the Privy Council the case having been hung up by his persiStence in asserting an unwarranable claim of interests from the date of the mortgage.
