The time is fast approaching when the Legislative Assembly will insist that the Members of the Executive Council who may be selected by H. E. the Viceroy must command the confidence of the Legislature or in other words that the principle of -res ponsibilit:-.- be introduced in the Cabinet Council of the Government of India. [...] It must-not be supposed that the highest law offices in Bengal have gone to the Indians out of any preconceived policy on the part of the Local or the Imperial Governments for the Indianisation of the services in this country. [...] Gibbons' term of office is about to expire the Government of India is now convinced that the nomination of an 'Advoca te-General of 'Bengal directfrom the Bar in England is neither fair to the Member of the English Bar so appointed nor to the Members of the Cacutta Bar or to the interest of the Government or the people of this country. [...] - At the intermediate stage in order to enable or compel the parties to take necessary steps in the prosecution of the case the Court may fix date for somparticular action to be taken: Those dates are dates for the hearing of that partcular matter which is specified in the order of the Court." Hence it appears that the first hearing of the suit as contained in Or. [...] Hence the practice of the Mofussil Courts to give a precise date solely for - the production of documentary evidence on a date subsequent to the framing of the issues is not repugnant to the provisions of the Civil Procedure Code though not expressly santioned by it.
