And lastly the applicant has to satisfy the Court that the detention is under such circumstances that it amounts to an offence—a burden by no means easy to discharge having regard to the fact that in most cases the applicant is not likely to have any firshand information as to the circumstances of the detention particularly in those cases where the detention is by a police officer.
