The report of the Chemical Examiner did not contain any information as to the amount or percentage of the poison cotained in the uneaten food and the stains of vomit nor did it supply anything to enable the Court to judge whether the amount of poison found in any of the exhibits would be sufficient to cause death. [...] Of course it is not meant that it is 'duty-'of the learned Judge who is trying the case to dictate to the prosecution the order of the witnesses bat it is in the discretion of the learned Judge who has control over the trial to suggest to those who are responsible for the conduct of the prosecution; that the prper method and order of calling the witnesses should be observed. [...] P. C. Before passing the order for rejection the Magistrate at the rquest of the second party had passed an order directing the Police to have the paddy cut and deposited with the r.earest panchayet. [...] The second party thereupon made an application to the District Magistrate for revision of the last order of the Magistrate to have the paddy made over to the first party. [...] Held—That the objection of the Government pleader was a perfectly solnid and the learned Sessions Judge should hay° directed the evidence of the Sub-Deputy Magistrate'to be taken in acc idance with the provisions of sec.
