The office of the Chief Presidency Magistrate hats for long been filled by members of the Bar and we „see no reason why the Goernment of BerlaVhould not have got a meber of the Calcutta Bar to fill the office. [...] The decision of the Court of Appeal in Enland condemning thedeportation of the Irish leader O'Brien as illegal has been folloWed by the introduction in the House of Commons of an Indemnity Bill barring all legal claims for compensation by deportees. [...] It is obvious that high reasons of state should at times rquire the Government to take as we say the law into their own hands; but it is one of the principles of the British ConstitUtion that that does not oust the jurisdiction of the Courts to test their legality nor does it take away the right of private individuals to proceed against persons actually employed in carrying out the Government [...] - The main potent argued in the appeal was as to whetlitt the ' 1-rd of his estate which the testator Ordelvi to to set aside for the wakf was to be calculated as at the date of the testator's death or Is at the time of distribtiOn.
