Said His Lordship It may not be out of place to observe upon the practice of legislation by means of Orders in Council that though the practice may be a convenience to Parliament it is one which leads to inconveniences and difficulties and dangers of which the present. [...] 222) the testator directed that his executors should get a Siva's temple erected at a reasoable cost in a suitable place within the copound of the brick-built Baitakhana: there Wu.4 a further direction that the surplus of his icome after meeting all the expenses specified in the Will was to be used " in just and prper act " for the testator's benefit. [...] In this case the direction given by a testator in his Will was as follows As to the rest and residue of the estate I give and devise.the same to my executors in trust to spend and give away the whole thereof in charity in such manner and to such religious and eharitable purposes as he may in his discretion think. [...] M r. lian►krishna in his treatise on :Hindu law eites in this connection a case reported in 11 Indian Cases 625 (.1 kh 1 v..1-?ebati): In this case a Hindu testator by his Will dedicated all his properties to a deity and stated that therein his heirs should have no right of ownership but in the next clause of the Will he directed that.-nth of the profit should be devoted to the worship of the [...] - to the repair of the house of the deity and the remaining moiety his heir should get from the manager for the purpose of rendering help in the Sheba of the idol.
