The last day of the Bengalee year is also the last day of the spring and the Bengalee new year is the first day of the summer. [...] In the case in question it has been held that the filing of a written statement by the accused relieves the Magistrate from the necesity of examining the accused orally isn refeence to the matters elicited in the cross-exmination and re-examination of the prosection witnesses anJ that non-observance of the procedure laid down in sec. [...] There is a conflict of rulings as to what should he considered the value of the suit for the purpose of jurisliction. whether It should he the value of the entire property sought to be partitioned or the value of the share of the Plaintiff in the said property. [...] The Bombay' Madras and the Allahabad High Courts have invariably held that in a suit for partition for Vie-1)11mo% of jurisdiction the value of the slit is not that °Pate entire prperty but only of the share of the Plaintiff in the said property. [...] in referring to 5 P. L. J. mentioned above which they refused to follow made the following observations :— Their Lordships (Jwala Prosad and Adami JJ.) held that having regard to the nature of the suit and the reliefs asked for the value of the suit for purpose of jurisdiction was the 'value of the Plaintiff's share in the properties a?id not tale wing of the entire joint family prperty.
