* * The prison van was at the Court-gate ready for we ; but in view of the attitude of the crowd I was conveyed in a private carriage leaving the Court by the Judges' etrance and was taken by a round-about way to the residency jail. [...] The two officers who are generally entrusted with the work of preparing the jury list are the Sessions Judge and the Collector and if in ease of an emegency the Sessions Judge after making due enquiries puts a personwho happens to be present in Court into the jury box to make up a deficiency it seems to be all eight and not in any way inconsistent with the policy of the Code of Criminal Procedu [...] What in the opinion of the writer is how wanted is the repeal of the whole enactment and the framing of a new Act on liberal lines. [...] in the first instance that the jurors shall be chosen by lot from the persons summoned to act as such etc." Then come the provisos of which the second runs as follows :—" In case of a defciency of.persons summoned the number of jurors required may with the leave of the Court be chosen from such other persons as may be present " Now it is a recognised rule of interpretation that a word i [...] The method followed is for the Court to take the initiative ifs the sense that without the aplication of either the prosecutor or the accused the Sessions Judge askes the Nazir to go into the Court compound and find out some persons to serve as jurors and these persons arebrought up in about five minutes.
