The Magistrate must also allow the Defendant a reasonable time to semi for Counsel and adjourn the examination for that purpose and must upon the request of the Defendant require an officer to take a message to such Counsel in the town or city as the lfendant may name. [...] But in the absence of Pules made by the High Court the.proviskins of the Civil Procedure Code would govern the procedure of the Mofussil Appellate Courts. [...] The Plaintiff brought the suit in the Court of the first Munsif of Berhampur against ti/.! Defendant for declaration of Plaintiff's title le the boundary wall betwee u the Plaintiff' house and the Defendant's house and for rmoval of a privy and a hilt the roofs of which rested on this wall 'and for a permanent injun: tion against the Defendant so that she might* not construct any suet privy [...] On appeal by the Defendants the District Judge of Berhampur while agreeing with the first Court in declaring Plaintiff's title to the wall refused to grant consequential relief holding that the order passed by the learned Munsif went beyond the 'requirements of the case that it was unseemly that neigbours should quarrel over such petty matters and that justice would be done if the present priv [...] Herd—That the lower Appellate Court having agreed with the finding of the Munsif that the wall belonged to the Plaintiff it was wrong in modifying the decree passed by the Munsif and in refusing to grant causequential relief to the Plaintiff.
