We have always been staunch supporters of the personal liberty of the subject and opposed to the passing of the Bengal Criminal Law Amendment Act of 1925 by certification by the Governor after it was rejected by a majority of votes in the Bengal Legislative Council. [...] So far as the argument turned on the question that the Act was obnoxious to the provisions of the Magna Carta and the Bill of Rights which were suposed to be in operation in -Calcutta prior to 1860 a sufficient answer has been given to it in the judgment of the learned Chief Justice and we have no desire to dilate on it. [...] 65 of the Government of India Act of 1919 there can be no question that the criminal law of India is now governed by the provisions of the Code of Criminal Procedure and the Penal Code and the same may be amended added to and supplmented by the Indian legislature. [...] We have seen that the -powem given to the Government of 'India for the codification of the criminal law of India have supplanted the English statutes since the Criminal Codes came into operation. [...] The decree-holder's man the complainant went with the Nazir's party to the colliery but they were driven back by the Petitioner in the course of which it was alleged the complainant was struck.
