The Insurance Company resist the claim on the ground that either the parcel never contained the diamonds or else that they were abstracted from the custody of the postal authorities with the connivance of the senders. [...] The main question in the appeal was whther any portion of the monewhich the Repondent had agreed to piy under the lease was irrecoverable as being an abwab " within the meaning of the Bengal Tenancy Act. [...] The learned author is very modest when he says that the object of the work is to afford assistance to those officers of ' Goverment and others in remote places who are not provided*with the ordinary works of reference and for whom the construction of this branch of the law must necessarily present great diffculties. [...] The comment on the subject is of considerable interest especially after the recent decision of the Calcutta High Court in which the learned Chief Justice has held that the prerogative writ of habeas corpus is not at all available in this country and the only powers which the High Courts have in this connection are those provided for in sec. [...] 21 prior to r. 64 had nothing to do with the executing Court : Held—That there being no limit either of time or of the stage of litigation in which claims should be preferred and the High Court Original Side having lost seisin of the decree and all powers relating to execution of the dcree having been vested in the Nuddea Court by reason of the decree being transferred to that.
