Since 1878 (by the Opium Act and the Bengal Excise and Licensing Act) the Officers of the special Opium and Excise Departments were empowered to search and arrest to issue warrants and to seize and detain to report on all the partculars of the cases and to take measures necessary for " the disposal according to law " of offenders under those Acts. [...] In a suit in 1910 for the removal of the mutwalli and framing of a scheme for the management of the wakf a declaration was also prayed for that the property in suit was a validly endowed wakf. [...] The main question is as to the validity of an ultimate trust of the income in favour of the male heirs of the donee for life where those male heirs are all persons born.before the settlement was made. [...] The vendee undertook to pay certain sums of money into the Bank of Upper India and to arrange for the transfer of a debit balance to the account of the vendor with that Bank to his own account. [...] Since the appeal was entered the Privy Council had given their decision in the Dhalbhum Raj case and as the facts in the present suit were indistinguishablefrom the facts in that decision the appeal was dimissed.
