By this lie means to say the same thing which we have said before and have repeated to-day that if the Hartal is voluntary or even if it is the result of any notification or appeal of one or more persons in the nature of a request to the general public to observe it on a particular day or part of the day the person or' persons issuing the appeal cannot be held responsible in law by any person who [...] With the advance of the human race in intellgence and morality and in enlightenment and civilisation the criminal law has been steadily improving subjectively and objetively both as regards the character and etent of crimes and the nature and severity of punishment as also as regards the condtions of liability and the method of enforing it. [...] The effort of molern legislation is to combine as far as possible both the modes with a view to attain the greatest success in the prevention of crime the combination appearing to be best adapted to secure that object. [...] The following aetraet contains the learned writer's views on punishment as a preventive and will be read with interest :- " Punishment as a preventive.—Consdering now the second question the prevetion of further wrong-doing by the rcollktion of the punishment for the last here again we cannot go along with most of the modern radicals in criminology. [...] The only ground of punishment is the danger of the State and the basis and justification of punishment are not to be looked for in the equity or justice of that punishment but in its necessity and adequacy for the prevetion of crime in the future."
