He observed that there might have been justification for the executive to assume extraordinary powers during the European War though uwarranted encroachments on the liberty of the subject or the ousting of the jurisdiction of the Court of law by the War Regulations called forth at the time a dignified and learned protest from Lord Shaw. [...] 4 of the Act the Bar Council is to consist of 15 members of whom one shall be the Advocate-General four incluing not more than two Judges of the High Court shall be persons nominated by the High Court and 10 shall be elected by the Advocates (in the case of the first Bar Council by the Advocates and vakils) of the High Court from amongst their number. [...] ea* The Resolution of the High Court dated 8th February 1928 passed under this last sub-section is as follows :— It is hereby resolved that of the 10 elected members of the Bar Council to be costituted' for the High Court of Judicature at Fort William in Bengal one-half shall be persons who have for the minimum period of 10 years been entitled to practise in the High Court in the exercis [...] The blanks in the space for the date of the Resolution referred to in the said r..13 would seem to indicate that though' the notice. [...] 6 (2) of the Act which confines the rule-making power of the High Court to a. particular occasion only that is to the making of the first rules and expressly confers the power of amendment or rescission on the Bar Coucil.
