Apart from anmaly thus introduced into the English law the above throws an interesting sidlight on the independence of the English Judges and the Jury and as to how even in England the Executive and the Legislature used to go out of their way to satisfy the whims and caprices of the Crown during the last century. [...] 7 of the present Act simply provides that all infringing copies of any work in which copy-right subsists or of any substantial part thereof and all plates used or intended to be used for the production of such infringing copies shall be deemed to be the property of the owner of the copy-right who accordingly may take proceedings for the recovery of the possesion thereof or in respect of the con [...] 5 of the Copright Act 1847 contained a proviso to the following effect :— Provided always that the omission to make such entry shall not affect the copy-right in any book nor the right to sue or proceed in respect of the ifringement thereof.except the right to sue or proceed in respect of the infringement thereof under the provisions of this Act." In.victkv of this express provision and re [...] a fundamental misconception of law to supose that the legislature in the Act of 1847 laid down that failure to make the payment of registration fee deprived the owner of a copy-right of his right altogether. [...] In an appeal to the High Court against the lower Court's decree an application was made for stay of execution of the decree and the execution was stayed on condition of the Appellant's furnishing security for the due performance of any decree that might be ultimately passed.
