[...] 92 of the Civil Procedure Code does not apply to a suit where the Plaintiff claims possession of the endowed property on the allegation that he is the duly appointed trustee and that the Defedant is a trespasser or to a suit between persons who individually claim a right to succeed to the office of trustee. [...] (2) That in the absence of a provision in the deed prescribing the mode of devoltion to the office of shebair and in the ascree of a custom to the contrary the power to appoint a successor to a shebuit reverts to the heirs of the foUntter of the trust and a sitebait has no right to appoint a succeor to himself.
