Justice Tomlin has been promoted to the highest Court of Appeal from the position of a Judge of the Chancery Division of the High Court of England. [...] We invite the attention of the Government as also of the general pulic and particularly of the Members of the Bengal Legislative Council. [...] 195 and 476 the former is the provision of law which bars the taking of cognizance of certain offences unless the conditions laid down in the Code are fulfilled; the latter has nothing to do with the taking of cognizance but lays down when and how the Court may make a complaint. [...] 1.95 if it is committed by a party to a proceeding the Magistrate can lake conizarce of it only on the complaint of the Court and not otherwise but if such offence is committed by a person who is not a Marty to a proceeding " the Magistrate may take cognizance of it in the usual way without the complaint of the Court. [...] 4'76 unless the expression " in or in relation " to a proceeding in Court is interpreted to refer to the commission of the offence by a party " to a proceeding " in Court which seems to be a construction of the section which the words thereof do not very well bear.
