P. and Assam Civil Courts Ac - an appeal from a decree or order of a Munsif shall lie to the District Judge and therefore the Court of the District Judge is the Court to which the Court of a Munsif is subordinate within the on of sec. [...] In computing this period the time taken up in the Court of the Sessions Judge in connection with the application in that Court for a reference to the High Court is net to be excluded. [...] The suit was for a declaration that under the Mahommedan law the Plaintiff's marriage solemnised unde the Hindu law on 11th February 1928 stood dissolved and that the Plaintiff was free and competent to marry again and for costs of the suit. [...] II (Fourth Edition 1917) while discussing Ram Kumari's case on page 438 cf the treatise suggests as follows:— " The learned Judges in the case referred to do not say what would happen on the refusal of the Judge or Magistrate to listen to the prayer of the woman or if the husband dclinF to accede to her demand. [...] It is to be presnmed that the principle was enunciated for satisfying the Court's conscience and that on her making the application the fire marriage would be regarded as dissolved."
