They consider that the present syllabus of studies should be revised and the full Court recommends that the revision should take the form of certain Acts as also Full Bench decisions of the Calcutta High Court for the last fifteen years and all cases reported in the I. L. R. Calcuttta Series for the ten years immediately preceding the examintion being added. [...] There the learned: correspondent mentions three English cases in a group in support of the principle propounded by him that it by the law of England the authority of an agent is determined by the death of the principgd whether the fact of death is known or not." In those three cases Smout v. r/bery 10 M. & W. 1 finds a place. [...] properties and also the deficit court-fees of the trial Court: Held (KING J.)—That liability to pay court-fee depends in the first instance upon the allegations made in the plaint and the relief sought apart altogether from the evdence. [...] And in a partition suit when the allegation is that the Plaintiff is in joint possession and the relief sought is separate possession of the share claimed by the Plaintiff the proper court-fee is Rs. [...] In the Bombay Presidency the marriage of a Brahmin with a Sudra woman is valid and the son born of such marriage is legitmate and is entitled to a share of the prperties of his ancestors ; but the share of such son in the properties of his father as also of his uncle cannot according to the Mitakshara be more than one-tenth.
