[...] seeking to appeal to the Privy Council and whatever may be the value of the property with respect to which the claim is brought if in fact the total amount of the subjecmatter of the suit so far as the Appellant's interest is concerned is under Rs. [...] 90 of the Probate and Adminitration Act the mortgage was not void but voidable at the instance of any one interested in the property and that the judgment-credtor was not entitled to avoid the mortgage without paying of the money bona fide avanced by the mortgagee.
